These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. Governing Law and Jurisdiction

The Products and/or Services are managed by BP Records Pvt. Ltd., a legal entity located at 6D, Kences Enclave, T Nagar, Chennai. The provision of services by BP Records is governed by Indian Law and any dispute related to the provision of services and these Terms of Use will be governed by the laws of the State of India, excluding its conflicts of law provisions. 

 

Intellectual Property

Intellectual Property refers to all aspects of the Website and the related Content. Intellectual Property will mean: trademarks, service marks, trade names, business and domain names, rights in trade dress or get-up, rights in goodwill or to sue for passing off, unfair competition rights, rights in designs, rights in computer software, database rights, topography rights, moral rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications for, and rights to apply for and be granted renewals or extensions of, and claim priority from such rights, and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world; patents, copyrights and neighbouring and related rights, trade secrets.

Returns
Our Returns Policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Refunds (if applicable)

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

If you haven’t received a refund yet, first check your bank account again.

Shipping
To return your product, you should mail your product to: 6D, Block 2, Kences Enclave, T Nagar, Chennai.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

You agree that for any liability related to the purchase of products or services bundled with the products, whether for breach of contract, warranty, negligence, strict liability in tort or otherwise, BP Records shall not be liable or responsible for any amount of damages above the aggregate dollar amount paid by customer for the purchase of products or services under this agreement giving rise to such liability. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

 

Dispute Resolution and Applicable law

You agree to comply with all applicable laws and regulations of the various states and of India. You agree and represent that you are buying for your own personal use only, and not for resale or export.

All disputes will be subject to arbitration at Chennai (insert city of operation) in accordance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted in the English language and shall be conducted by a sole arbitrator mutually agreeable to both parties. 

Arbitration awards shall be reasoned awards and shall be final and binding on BP Records and the disputing User and shall be enforceable in any court of competent jurisdiction. 

 

Term and Termination 

The Agreement will remain in full force and effect while You are registered with the Platform or use any Services available on the Platform in any form or capacity. 

BP Records reserves the right to terminate its Services provided to You in the event of a breach of any terms contained in the Agreement, misrepresentation of information, breach of applicable law or if BP Records is unable to verify or authenticate any information You submit. 

The User may terminate the Agreement at any time, provided that the User discontinues any further use of the Platform or Services. 

It is specifically clarified that any termination of the Agreement by a User shall not cancel the User’s obligation to pay for any Services availed or purchased on the Platform, or any other obligation which has accrued, or is unfulfilled and relates to the period, prior to termination.
